Please read these Terms of Service (“Terms”, “Agreement”) carefully before using the melohosts.com website and the hosting services (“Services”) operated by Melohosts, a trading name of Melo Investments Limited (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

2. Payments and Renewals

By purchasing a Service, you agree to pay the specified fees. All fees are non-refundable unless otherwise specified in our 30-Day Money-Back Guarantee (which applies only to shared hosting plans).

Services are billed on a subscription basis (e.g., monthly, quarterly, annually). Your Service will automatically renew at the end of the billing cycle unless you cancel it through your Client Area at least 24 hours before the end of the current period. Failure to pay fees on time will result in suspension and, eventually, termination of your Service.

3. Acceptable Use Policy (AUP)

You agree not to use the Service for any unlawful purpose or in any way that violates our Acceptable Use Policy. This includes, but is not limited to:

  • Hosting or distributing malware, phishing sites, or engaging in spamming (unsolicited commercial email).
  • Storing or distributing illegal content, including copyrighted material you do not have the rights to.
  • Using excessive server resources (CPU, RAM, I/O) that negatively impact other customers on a shared platform. We reserve the right to suspend or terminate accounts that abuse server resources.
  • Engaging in any activity that compromises the security or integrity of our network or any other network on the internet.

4. Backups and Data Loss

Your use of the Service is at your sole risk. While we perform periodic backups for some services, we are not responsible for any data loss. You are solely responsible for creating and maintaining your own off-site backups of your website and data. VPS services are unmanaged, and backups are the customer’s full responsibility unless a separate backup service is purchased.

5. Limitation of Liability

In no event shall Melohosts (Melo Investments Limited), its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you must do so via our Client Area.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Zambia, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this site and/or by emailing you.
